A lawsuit has been brought against James Tillman, co-owner of First Watch restaurants in Springfield. The suit accuses Tillman of fraudulent actions and misappropriation of funds, putting Ozark Endeavors, the restaurant industry entity they both manage, under serious strain.

Tillman is under investigation for alleged mismanagement of company assets, leading to a credibility loss among stakeholders. His co-partner, Joseph Hulston, and company employees have expressed concerns over these issues, contributing to the company’s current legal and public relations troubles.

Allegations against Tillman include unsanctioned salary hikes and payments to family members, misuse of company credit cards, unauthorized relocation of the head office, and charging unauthorized personal expenses to the company. According to the lawsuit, all of these deeds were done without Hulston’s knowledge.

Hulston and Tillman are also involved in Kansas & Kearney LLC, a real estate venture, where Hulston holds majority shares.

Accusations and lawsuit against First Watch co-owner

The lawsuit mentions Tillman’s attempted property sale without Hulston’s agreement, pointing to another potential conflict of interest. This has led Hulston to contest the sale in court, claiming that Tillman cannot unilaterally sell shares.

Further litigation alleges that Tillman diverted funds and opportunities from Ozark Endeavors for his personal gain and spread damaging accusations about Hulston. In response, Hulston and several LLCs are seeking both punitive and actual damages, and for Tillman’s removal as LLC manager, and the imposition of Tillman’s liability for the lawsuit’s legal costs.

Another accusation indicates that Tillman boosted his salary from $60,000 to $210,000 without Hulston’s approval, also providing inflated earnings to his wife and daughter. The case continues in Greene County Circuit Court.
